Many men wait until a separation has already happened before speaking with a lawyer. By then, important decisions may already have been made: who stays in the home, what the children’s schedule looks like, and what happens to joint accounts.

If you are thinking about separating, or suspect your partner is, getting advice early is one of the most practical things you can do. A confidential consultation does not commit you to anything, and it does not mean the relationship is over.

Planning is not about gaining an unfair advantage. It is about understanding your rights and obligations, avoiding costly mistakes, and making sure your children’s needs and your own are considered from the start.

Our Calgary family lawyers help men plan calmly and carefully, with an approach that keeps conflict as low as possible.

How to Prepare Before You Separate

This overview is general information, not legal advice about your situation. If you or your children are unsafe, your safety comes first: call 911 in an emergency.

1. Get Confidential Legal Advice Early

A single consultation can give you a clear picture of what the law says about parenting, support and property in your situation, and which steps to take, or avoid, next. What you discuss with your lawyer is confidential.

2. Understand the Key Dates

The date you began living together, the date of marriage (if married) and the date of separation all matter. Separation can happen even while you live under the same roof, if the relationship has ended. Under the Divorce Act, a divorce is most often granted after the spouses have lived separate and apart for at least one year.

3. Gather Your Financial Information

Collect copies of tax returns and Notices of Assessment, pay stubs, bank and investment statements, pension statements, mortgage and debt statements, and, if you own a business, corporate financial statements. Records showing what you owned when the relationship began, and any inheritances or gifts, are especially important. Our Business Owner’s Divorce Checklist is a helpful starting list, and our Property Division Worksheet gives you a rough picture.

4. Think About Your Children First

Courts decide parenting based on the children’s best interests, and they often look at how parenting has worked before and since separation. Stay involved in day-to-day parenting, think about a realistic schedule that fits your work, and avoid discussing the separation with the children before you and your partner have agreed on how to tell them. See parenting time for fathers.

5. Plan Your Living Arrangements

Moving out does not give up your property rights, but it can affect parenting arrangements if it is not planned. If you can, agree on a temporary parenting schedule and who pays which household costs before anyone moves.

6. Build a Realistic Budget

Two households cost more than one. Estimate your monthly expenses after separation, and get a sense of likely child and spousal support. Our child support calculator and income for support tool can help.

7. Handle Money Carefully

  • Do not empty joint accounts, hide assets or run up joint debt. These steps damage credibility and can lead to court orders.
  • Keep paying household bills that you normally pay, unless you agree otherwise.
  • If you own a business, keep running it normally and avoid unusual changes to salary or dividends.
  • Keep records of any payments you make after separation.

8. Protect Your Privacy, Lawfully

Update passwords on your own email, phone and financial accounts, and consider opening a bank account in your own name. Do not access your partner’s email, phone or accounts without permission, which can have serious legal consequences and harm your case.

9. Keep Communication Calm and in Writing

Assume that texts and emails may one day be read by a judge. Stay respectful, stay off social media about your relationship, and avoid heated in-person arguments. If conflict escalates, step away.

10. Consider How You Want to Resolve It

Many separations are resolved through negotiation, mediation or a collaborative process, which is usually faster, less expensive and easier on children than going to court. Knowing your options early helps you choose the right path.

I called Bellagio looking for someone to assist in the creation of a family trust. The reception could do with more training, but owner Violeta (hope I spelled that correctly) took the time to call me back very quickly and address my request. She sounds genuinely concerned about ensuring everyone that calls is treated well.

FAQs About Planning a Separation in Alberta

No. A confidential consultation can help you understand your options and avoid mistakes, whatever you decide. Speaking with a lawyer does not mean the relationship is over.

Yes. Separation depends on whether the relationship has ended, not only on where you live. Keeping a record of when and how the relationship ended can be helpful.

A divorce is most often granted after the spouses have lived separate and apart for at least one year. Other issues, such as parenting, support and property, can be resolved before then.

Do not remove large amounts from joint accounts or hide assets. It can harm your credibility and lead to court orders. Opening an account in your own name for your own income, and keeping records, is a more sensible step. Get advice about your situation.

Tax returns, pay stubs, bank and investment statements, pension statements, mortgage and debt records, and business financial statements if you own a business. Records of what you owned at the start of the relationship, and any inheritances, are especially valuable.
