More couples are separating after 50, often after long marriages or relationships, and often when retirement is in sight. A “grey divorce” raises different questions than a separation at 35: pensions, CPP, retirement income, the family home, adult children, and estate planning.

For many men, the biggest worry is simple: will I still be able to retire, and when?

The rules are the same as in any Alberta separation, but the stakes and the timing are different. Decisions about pensions and spousal support made now can shape the rest of your retirement.

Our Calgary family lawyers help men separating later in life understand their options and make decisions that protect their long-term financial security.

What Is Different About Separating After 50

This overview is general information, not legal advice about your situation.

Pensions Are Often the Largest Asset

The portion of a workplace pension earned during the marriage or adult interdependent relationship is generally family property under Alberta’s Family Property Act. In a long relationship, that can be most of the pension. Defined benefit pensions need a proper valuation, and different rules apply to Alberta-regulated, federally regulated and public sector plans. If the pension is already being paid, the options for dividing it are different again.

Canada Pension Plan Credit Splitting

CPP credits earned during a marriage or common-law relationship can generally be split between the partners after separation, on application to Service Canada. This can affect both of your CPP retirement pensions. Time limits can apply, especially for common-law partners, so it should be addressed in your agreement and not overlooked.

Old Age Security is an individual benefit and is not divided, but your marital status can affect income-tested benefits, so update Service Canada after separation.

RRSPs, RRIFs and Investments

Registered accounts can usually be divided on separation by a tax-free transfer between spouses or partners, rather than by withdrawal. Non-registered investments may carry built-in capital gains. Two settlements that look equal on paper can be very different after tax, so tax should be considered before anything is signed.

Spousal Support Near Retirement

After a long relationship, spousal support can be significant and, in some cases, indefinite, meaning no fixed end date. The Spousal Support Advisory Guidelines generally suggest indefinite duration where the relationship lasted 20 years or more, or where the recipient’s age plus the years together add up to 65 or more (the “rule of 65”). Retirement can be a reason to review support, depending on its timing and whether it was reasonable. Care is also needed to avoid counting pension income twice, once as property and again as income for support.

The Family Home

Many couples separating later in life own their home outright or nearly so. Deciding whether to sell, whether one person can buy out the other, and whether either of you can afford to stay are often the central questions. For married spouses, the Dower Act can affect sales or mortgages of the homestead until the marriage ends.

Businesses, Farms and Succession

If you own a business or farm, separation may coincide with succession planning. Dividing value fairly without undermining the business or a planned transfer to the next generation takes careful structuring. See dividing a business or corporation in an Alberta divorce.

Update Your Estate Plan

In Alberta, a divorce, or the end of an adult interdependent relationship, generally revokes gifts to the former partner in a will, but separation alone may not. Beneficiary designations on RRSPs, RRIFs, TFSAs, pensions and life insurance are not changed automatically. Review your will, powers of attorney, personal directive and beneficiary designations early, keeping in mind any restrictions while your case is ongoing.

Adult Children and Family Relationships

Even when children are grown, separation affects the whole family. Adult children in university may still be entitled to child support in some circumstances. We encourage approaches that keep family relationships intact where possible, including mediation and negotiated settlements.

I called Bellagio looking for someone to assist in the creation of a family trust. The reception could do with more training, but owner Violeta (hope I spelled that correctly) took the time to call me back very quickly and address my request. She sounds genuinely concerned about ensuring everyone that calls is treated well.

FAQs About Grey Divorce in Alberta

Generally, only the portion earned during the marriage or adult interdependent relationship is shared, and the division is usually done by transferring a share into a locked-in account rather than splitting monthly payments. After a long relationship, that portion can be large.

CPP credits earned during the relationship can generally be split on application after separation. Time limits can apply, particularly for common-law partners. Get advice on how CPP should be addressed in your agreement.

Not automatically. Retirement can be a material change that justifies reviewing support, but the court looks at whether the retirement was reasonable and at both people’s circumstances. Get advice before stopping or reducing payments.

After long relationships, support is often indefinite, meaning no fixed end date. The amount can still be reviewed or varied later if circumstances change, such as retirement or the recipient’s income.

Review it now. Separation alone may not revoke gifts to your spouse in your will, and beneficiary designations are not automatically changed. Get advice on what you can change while your family law matter is ongoing.
