Spousal support is often the most uncertain part of a separation. Unlike child support, there is no single table that sets the amount, and many men are unsure whether support will be payable at all, how much it might be, or how long it could last.

That uncertainty makes it hard to plan: where you will live, how you will manage your household, and when you might retire.

Spousal support is not automatic, and it is not a penalty. It is meant to address the financial effects of the relationship and its breakdown. Whether it applies depends on the facts of your relationship, and the law applies equally regardless of gender. Men can be entitled to receive spousal support, too.

Our Calgary family lawyers help men understand whether support is likely to be payable, what range the Spousal Support Advisory Guidelines suggest, and how to structure an arrangement that is fair and realistic.

How Spousal Support Works in Alberta

The overview below is general information. Spousal support is highly fact-specific, so speak with a lawyer about your situation.

Which Law Applies?

For married spouses who are divorcing, spousal support is governed by the federal Divorce Act. For adult interdependent partners (common-law partners), and for married spouses who are not seeking a divorce, Alberta’s Family Law Act applies. The principles are similar under both.

Is Spousal Support Payable? Entitlement Comes First

Before anyone discusses an amount, the court asks whether the person asking for support is entitled to it. Entitlement can arise on three main bases:

  • Compensatory: one partner gave up career or earning opportunities during the relationship, for example by staying home with children or relocating for the other’s job.
  • Non-compensatory (needs-based): one partner faces financial hardship after the relationship ends, and the other has the ability to pay.
  • Contractual: the partners agreed to support in a marriage contract, cohabitation agreement or separation agreement.

The court considers factors such as the length of the relationship, the roles each person played, and each person’s means and needs. The goals include recognizing economic advantages and disadvantages from the relationship and, where practical, promoting each person’s economic self-sufficiency within a reasonable time.

How Much and How Long? The Spousal Support Advisory Guidelines

Alberta courts and lawyers commonly use the Spousal Support Advisory Guidelines (SSAG). They are not law, but they provide ranges for amount and duration based on each person’s income, the length of the relationship, and whether there are children.

  • Without children: the amount is based on the income difference and the length of the relationship, and duration is often in the range of one-half to one year of support for each year the parties lived together.
  • With children: a different formula applies that takes child support into account, and duration is often tied to the ages of the children as well as the length of the relationship.

For longer relationships, support can be indefinite, meaning no fixed end date, though it may still be reviewed or varied later. Where in the range a case lands depends on the facts, which is where careful preparation matters.

Child Support Comes First

Where both child support and spousal support are in play, the law gives priority to child support. This can affect both the amount of spousal support and the timing of any review.

Income Issues

Spousal support depends on accurate income figures for both people. Questions about self-employment income, corporate income, bonuses, and whether either party should have an income imputed to them are common. Just as with child support, full financial disclosure from both sides is essential.

Tax Treatment

Periodic spousal support paid under a written agreement or court order is generally tax-deductible for the payor and taxable for the recipient. Lump-sum payments are usually treated differently. How support is structured can make a real difference to what each person keeps after tax, so it is worth planning.

Changing or Ending Spousal Support

Support can be varied when there is a material change in circumstances, such as a significant change in income, the recipient becoming self-sufficient, repartnering, or retirement. Some agreements and orders include a review date or a set end date. Until a change is agreed or ordered, the existing terms apply.

I called Bellagio looking for someone to assist in the creation of a family trust. The reception could do with more training, but owner Violeta (hope I spelled that correctly) took the time to call me back very quickly and address my request. She sounds genuinely concerned about ensuring everyone that calls is treated well.

FAQs About Spousal Support for Men in Calgary

Not necessarily. Spousal support is not automatic. The person asking for support must first show they are entitled to it based on compensatory, needs-based or contractual grounds. If entitlement is established, the amount and duration are then considered.

Yes. The law applies equally regardless of gender. A man who gave up earning opportunities during the relationship, or who faces financial hardship after it ends, may be entitled to support.

Possibly. Alberta’s Family Law Act allows adult interdependent partners to claim support. This generally includes people who lived together in an interdependent relationship for at least three years, or for less time if they have a child together.

It depends on the length of the relationship, the ages of any children and the other circumstances. The Spousal Support Advisory Guidelines often suggest a range of one-half to one year of support for each year together, and support may be indefinite after longer relationships.

You can apply to vary support when there is a material change in circumstances. Retirement can be a change, depending on its timing and whether it was reasonable. Get advice before stopping or reducing payments.

Periodic spousal support paid under a written agreement or court order is generally deductible for the payor and taxable for the recipient. Lump-sum payments are usually treated differently. Talk to your accountant about your specific situation.
